Terms of Service

These Terms of Service (“Terms”) govern your use of our website and the purchase of products or services from 3D Verse Limited (“3D Verse”, “we”, “us”, or “our”).

By accessing our website, placing an order, accepting a quote, submitting a custom project, or purchasing products or services from us, you agree to these Terms.

Please read them carefully before completing your purchase.

1. Our Products and Services

3D Verse Limited provides products and services that may include:

  • 3D printed products;

  • collectible items, displays and accessories;

  • custom 3D printing;

  • prototyping;

  • 3D modelling and design;

  • reverse engineering;

  • replacement parts;

  • customised products;

  • small-batch manufacturing; and

  • other related products and services.

Product and service availability may change without notice.

We reserve the right to refuse any order or project where we reasonably believe we cannot safely, legally or appropriately manufacture or supply the requested item.

2. Acceptance of Orders

An order submitted through our website is an offer to purchase from us.

We reserve the right to accept, decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • incorrect pricing or product information has been published;

  • payment cannot be verified;

  • we suspect fraud or unauthorised payment;

  • a custom request cannot reasonably be manufactured;

  • the requested product may infringe another person's intellectual property rights;

  • the requested product may be unlawful or unsafe to manufacture or supply; or

  • circumstances outside our reasonable control prevent us from fulfilling the order.

If we cancel an order after payment has been received and before goods or services have been supplied, we will refund the applicable amount paid, except where costs have already been reasonably incurred for an authorised custom or made-to-order project and applicable law permits those costs to be retained.

3. Prices and Payment

All prices are displayed in New Zealand dollars unless otherwise stated.

GST will be included or applied as indicated on the website, invoice or quotation.

You agree to provide current, complete and accurate billing, shipping and contact information when making a purchase.

Orders may not enter production or be dispatched until the required payment has been received.

For custom projects, we may require:

  • full payment before production;

  • a deposit;

  • staged payments; or

  • another payment arrangement specified in the quotation.

Any payment requirements stated in a custom quotation form part of these Terms.

4. 3D Printed Products – Important Acknowledgement

You acknowledge that 3D printing is a layer-by-layer manufacturing process and does not produce exactly the same surface appearance as injection moulding or other mass-manufacturing processes.

By purchasing a 3D printed product from us, you acknowledge and accept that normal characteristics may include:

  • visible layer lines;

  • seam or start/stop lines;

  • minor support marks;

  • small contact marks;

  • slight surface irregularities;

  • minor variations in surface finish or texture;

  • small dimensional variations;

  • slight colour or shade differences between filament batches;

  • minor variations between individual printed items; and

  • minor differences from product photographs caused by the manufacturing process.

These characteristics are inherent or reasonably expected characteristics of 3D printing and are not, by themselves, considered product faults.

Each 3D printed product may therefore be slightly unique.

Nothing in this section limits your rights where a product has an actual fault or otherwise fails to meet a guarantee that applies under New Zealand law.

5. Dimensions, Tolerances and Product Specifications

Measurements displayed on our website or provided in quotations are intended to describe the approximate finished dimensions of the product unless a specific manufacturing tolerance has been agreed in writing.

Because of the nature of additive manufacturing, material shrinkage, machine tolerances and finishing processes, minor dimensional variation may occur.

If a product must fit a specific component, opening, machine, mounting point or other item, you must inform us before ordering where exact fit is critical.

For custom manufacturing, any required tolerances must be agreed with us before production.

We are not responsible for fitment issues resulting from incorrect measurements, incomplete information or specifications supplied or approved by the customer.

6. Colours and Product Images

We make reasonable efforts to represent our products accurately.

However, the appearance of colours may vary due to:

  • lighting conditions;

  • photography;

  • screen or monitor settings;

  • filament or material batches; and

  • manufacturing processes.

Minor colour differences are not, by themselves, considered faults.

Product photography may also show examples of a product rather than the exact individual item that you will receive.

7. Custom and Made-to-Order Products

Custom, personalised and made-to-order products are manufactured according to the information, specifications and selections provided or approved by the customer.

You are responsible for checking the accuracy of all relevant information before approving production, including:

  • dimensions;

  • spelling;

  • names or wording;

  • quantities;

  • colours;

  • orientation;

  • fitment requirements;

  • design requirements; and

  • other specifications.

Once production or design work has started, changes may incur additional charges.

A requested change may also require a revised quotation or delivery timeframe.

Custom and made-to-order products cannot be returned or cancelled solely because of change of mind once work or production has commenced, subject to your rights under applicable New Zealand law.

8. Design Approvals

For some custom projects, we may provide drawings, renders, prototypes, samples or other materials for customer approval.

Where approval is requested, production may not begin until approval has been received.

By approving a design, drawing, dimension, prototype or specification, you confirm that you have reviewed the information provided and that it reflects your requirements.

If you request changes after approval, additional design, material or production charges may apply.

Approval does not excuse an error caused solely by us where the final product materially differs from the approved design or agreed specifications.

9. Reverse Engineering and Replacement Parts

Reverse-engineered and custom replacement parts may be developed from:

  • physical samples;

  • customer measurements;

  • scans;

  • photographs;

  • drawings; or

  • other reference information.

Unless otherwise agreed in writing, reverse engineering does not guarantee an exact reproduction of an original manufacturer's component.

Our responsibility is limited to manufacturing according to the specifications and requirements agreed for the project, subject to applicable law.

The customer is responsible for informing us of any critical functional, dimensional, environmental, mechanical or safety requirements before production.

10. Customer-Supplied Files and Designs

Where you provide us with an STL, STEP, CAD file, image, logo, drawing, model or other material, you represent that:

  • you own the material; or

  • you have sufficient permission or rights to use it and authorise us to manufacture from it.

You must not submit material that infringes another person's copyright, trademark, design rights, patents or other intellectual property rights.

We may refuse to manufacture any design where we reasonably suspect that the customer does not have the necessary rights or where production may otherwise be unlawful.

To the extent permitted by law, you are responsible for claims, losses or expenses resulting directly from intellectual property material supplied by you where you did not have the necessary rights to use that material.

11. Ownership of Designs and CAD Files

Unless otherwise expressly agreed in writing, purchasing a custom-designed physical product from 3D Verse Limited does not transfer ownership of our underlying design files, CAD files, source files, manufacturing files, drawings, production methods or other intellectual property.

Where 3D Verse creates a design, CAD model or manufacturing file as part of a project, that intellectual property remains the property of 3D Verse Limited unless transfer of ownership has been specifically included and agreed in writing.

Payment for design or development work does not automatically constitute the purchase or transfer of the underlying digital design files.

Where ownership or delivery of CAD, STEP, STL or other source files is required, this must be specifically agreed as part of the quotation or project.

12. Our Intellectual Property

Unless otherwise stated, our website content and original materials, including our:

  • product designs;

  • photographs;

  • graphics;

  • branding;

  • logos;

  • website content;

  • product descriptions;

  • custom models;

  • CAD files; and

  • other original materials

remain the property of 3D Verse Limited or their respective licensors.

You may not reproduce, manufacture, sell, distribute or commercially exploit our proprietary designs or digital files without written permission.

Purchasing a physical product does not give you permission to reproduce or manufacture copies of that product.

13. Quotations

Custom quotations are based on the information available to us when the quotation is prepared.

A quotation may be revised where:

  • specifications change;

  • additional work is requested;

  • measurements or information provided by the customer are incorrect or incomplete;

  • unexpected design or manufacturing requirements are discovered;

  • material requirements change; or

  • circumstances arise that could not reasonably have been identified when the quotation was prepared.

Any special terms included in a quotation form part of the agreement for that project.

Where a quotation states an expiry date, the quotation is only valid until that date.

14. Cancellation of Custom Work

If you cancel a custom project after we have begun design, procurement or production work, you may be responsible for reasonable costs already incurred, including:

  • design time;

  • engineering or modelling work;

  • materials purchased specifically for the project;

  • prototypes already produced;

  • completed manufacturing work; and

  • other project-specific costs already committed.

Any amount retained will be subject to applicable New Zealand law.

15. Production and Delivery Times

Production and dispatch timeframes provided by us are estimates unless we have expressly agreed in writing to a guaranteed deadline.

Custom manufacturing and 3D printing can occasionally be affected by machine failures, material availability, print failures, design changes, courier delays or other unexpected circumstances.

We will make reasonable efforts to complete orders within communicated timeframes.

Courier delivery estimates are provided by the relevant carrier and may be outside our direct control.

Nothing in this section limits any rights you may have under applicable law.

16. Shipping Information

You are responsible for providing a correct and complete delivery address.

If an order is returned to us because the address provided was incorrect, incomplete or inaccessible, additional shipping charges may apply before the parcel is resent.

Where a parcel appears lost or damaged in transit, please contact us so that we can investigate the matter with the courier.

You may be required to retain packaging and provide photographs or other information reasonably required for the courier investigation.

17. Returns, Refunds and Faulty Products

Returns, refunds, cancellations and faulty product claims are also governed by our Refund & Return Policy, which forms part of these Terms.

Nothing in these Terms or our Refund & Return Policy is intended to remove rights or remedies that cannot legally be excluded under New Zealand law.

18. Product Use

You are responsible for using products appropriately and for their intended purpose.

We are not responsible for damage resulting from misuse, unreasonable use, improper installation, incorrect assembly, modification, excessive force, unsuitable environmental conditions or use contrary to instructions supplied with the product.

Where you purchase a component for a particular mechanical, automotive, marine, industrial or other application, you are responsible for informing us before manufacture of any critical safety, load, temperature, chemical, UV, dimensional or regulatory requirements relevant to that application.

We may decline projects that we consider unsuitable for the intended application.

19. Website Information and Errors

We make reasonable efforts to ensure that information displayed on our website is accurate.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating to:

  • descriptions;

  • pricing;

  • promotions;

  • shipping charges;

  • availability; or

  • specifications.

Where a genuine error occurs, we may correct the information and, where necessary, contact you before completing the affected order.

If we cannot fulfil an order because of a material pricing or listing error, we may cancel the affected order and refund any applicable amount already paid.

20. Third-Party Services

Our website may rely on third-party providers for services such as:

  • website hosting;

  • payments;

  • shipping;

  • analytics; and

  • other ecommerce functionality.

Use of some third-party services may also be subject to the relevant provider's terms and policies.

We are not responsible for third-party websites that are not operated or controlled by us.

21. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded or restricted.

Subject to those rights and to the fullest extent permitted by law, we will not be liable for loss or damage caused by:

  • customer misuse or modification of a product;

  • incorrect information or measurements supplied by the customer;

  • use of a product outside its stated or reasonably intended purpose;

  • customer-supplied designs or files;

  • failure to tell us about a critical requirement before manufacture; or

  • circumstances outside our reasonable control.

For transactions where statutory consumer protections do not apply, and to the fullest extent permitted by law, our aggregate liability arising from the relevant product, service or project will not exceed the amount paid to us for that particular product, service or project.

22. Business Customers

If you acquire products or services from us in trade, and both you and 3D Verse Limited are in trade, you agree that the provisions of the Consumer Guarantees Act 1993 will not apply to that transaction to the maximum extent permitted by law where it is fair and reasonable for the parties to be bound by this provision.

This clause does not apply to ordinary consumer purchases where the Consumer Guarantees Act cannot lawfully be contracted out of.

23. Consumer Rights

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under the:

  • Consumer Guarantees Act 1993;

  • Fair Trading Act 1986; or

  • any other applicable New Zealand legislation.

If there is any conflict between these Terms and a mandatory requirement of New Zealand law, the mandatory legal requirement will apply.

24. Privacy

Personal information collected through our website or during an order or project will be handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

By providing information necessary to process an order, you authorise us to use that information for purposes reasonably connected with processing, manufacturing, delivering and supporting your order.

25. Changes to These Terms

We may update these Terms from time to time.

Changes will take effect when the updated Terms are published on our website and will generally apply to orders or agreements entered into after the updated Terms become effective.

The Terms applicable to an existing order or project will generally be those that applied when the order or agreement was entered into, unless otherwise agreed or required by law.

26. Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute relating to these Terms, our products or our services will be subject to the jurisdiction of the New Zealand courts or tribunals that have jurisdiction over the matter.
